Larchmont Personal Injury Law FAQ
What is a personal injury claim?
A personal injury claim is a legal remedy in the state of New York that allows you to seek compensation for damages caused by someone else’s negligence or wrongful actions. If you have been injured and someone else caused your injury, you may be able to seek compensation for pain and suffering, medical expenses, lost income and lost earning capacity, property damage, and other losses.
How long do I have to file a personal injury lawsuit?
In New York, the statute of limitations for personal injury claims is typically three years from the date of the accident. However, certain cases, such as medical malpractice, wrongful death, or government claims, have shorter timelines. While three years can seem like a long time, consult an attorney as soon as you can to ensure your claim is filed on time and to ensure that evidence in your case is protected.
What types of injuries can lead to a personal injury claim?
You may have a claim from:
- Car, truck, and motorcycle accidents
- Slip and fall accidents
- Medical malpractice
- Construction site and some workplace injuries
- Dog bites and animal attacks
- Injuries caused by unsafe products
- Nursing home abuse and neglect
- Wrongful death cases
- Pool injuries
- Unsafe premises
- Boating accidents
- Public transit accidents
- Head injuries
- Spinal cord injuries
Generally, if you’ve been injured due to someone else’s negligence, you may have a valid claim. If you’re not sure whether you have a claim and you have been injured, reach out to The Law Office of Mark A. Siesel for a free consultation. We can explain whether you may have a claim and what you can do next to file a claim.
How much compensation can I receive?
How much you can recover will depend on the specifics of your case, including the severity of your injuries and what caused them, as well as how they impact your life. You will generally be able to seek damages for pain and suffering, past and future medical expenses, past and future earnings and loss of earnings capacity, any property damage you suffered, and any incidental expenses you face as a result of your injury.
In some serious cases of gross negligence, a judge or jury may also award punitive damages to penalize the at-fault party.
Your attorney can help you determine how much compensation you may be eligible for. Your lawyer will also seek the maximum financial recovery for you, so you need to pay less out of pocket for your expenses.
Do I need an attorney?
While you can file a claim on your own through your insurance company, having an experienced personal injury attorney can help you seek fairer compensation. Your lawyer can negotiate with insurance companies and navigate the complicated processes involved in filing a claim.
Do I need to go to trial to get compensation?
Most personal injury cases settle out of court. However, if a fair settlement cannot be reached, your case may proceed to trial. At The Law Office of Mark A. Siesel, we always prepare each case as though we are going to trial. This gives us an advantage during settlement negotiations, because we have conducted an in-depth investigation and have an abundance of evidence. It also means we are ready to take your claim to court if that is the best way to secure compensation.
What should I do after an accident or injury to protect my right to compensation in Larchmont?
It’s important to seek medical attention immediately, both to protect your health and to start documenting your injury. Next, try to document as much as you can. Get photos of your injuries and accident scene, if you can, get witness information, write down what you remember. File a police report, if applicable.
You may also want to consult with a personal injury attorney as soon as possible. Your attorney can review any insurance company offers and can ensure you don’t make mistakes that could hurt your claim.
